THIS PRIVACY POLICY IS AN ELECTRONIC RECORD IN THE FORM OF AN ELECTRONIC CONTRACT FORMED UNDER THE INFORMATION TECHNOLOGY ACT, 2000 AND THE RULES MADE THEREUNDER. THIS PRIVACY POLICY DOES NOT REQUIRE ANY PHYSICAL, ELECTRONIC OR DIGITAL SIGNATURE.
THE PRIVACY POLICY IS A LEGALLY BINDING DOCUMENT BETWEEN YOU AND FARIDA GUPTA RETAIL PVT. LTD. (“FG”) AND GOVERNS THE COLLECTION, USE, STORAGE, PROCESSING AND DISCLOSURE OF INFORMATION RELATING TO USERS OF THE WEBSITE WWW.FARIDAGUPTA.COM, FG’S MOBILE APPLICATION, AND ANY OTHER ONLINE OR OFFLINE POINT AT WHICH FG COLLECTS YOUR INFORMATION IN CONNECTION WITH THE BRAND “FARIDA GUPTA” (COLLECTIVELY, THE “PLATFORM”).
THIS PRIVACY POLICY HAS BEEN PREPARED, AND WILL BE MAINTAINED/ AMENDED, IN COMPLIANCE WITH THE INFORMATION TECHNOLOGY ACT, 2000, THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OR INFORMATION) RULES, 2011 (“SPDI RULES”), READ WITH THE CONSUMER PROTECTION (E-COMMERCE) RULES, 2020, AND THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023 (“DPDP ACT”) TOGETHER WITH THE DIGITAL PERSONAL DATA PROTECTION RULES, 2025 MADE THEREUNDER, TO THE EXTENT THE SUBSTANTIVE PROVISIONS OF THE DPDP ACT AND DPDP RULES ARE IN FORCE FROM TIME TO TIME.
PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY ACCESSING OR USING THE PLATFORM, OR BY PROVIDING YOUR INFORMATION TO FG, YOU AGREE TO THE COLLECTION, STORAGE, USE, PROCESSING AND TRANSFER OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE THE PLATFORM.

DEFINITIONS
"You", "Your" or "User" means any natural person who accesses or uses the Platform, whether or not registered.
"Personal Data" or "Personal Information" means any data or information about a natural person that is capable of identifying such person, whether directly or indirectly.
"Sensitive Personal Data or Information" has the meaning assigned to it under Rule 3 of the SPDI Rules and includes, among other things, passwords, financial information such as bank account or payment instrument details, physical, physiological or mental health condition, sexual orientation, medical records and history, and biometric information.
“Processing" means any operation performed on Personal Data, including collection, recording, storage, use, disclosure, transmission, erasure or destruction.
"Applicable Law" means the Information Technology Act, 2000, the SPDI Rules, the Consumer Protection (E-Commerce) Rules, 2020, the DPDP Act and DPDP Rules, and any other law governing data protection and privacy in India, in each case as in force and applicable to FG from time to time.

INFORMATION FG COLLECTS
Information You provide directly: name, gender, date of birth, contact number, e-mail address, billing and shipping address, size and style preferences, order and purchase history, account credentials, feedback, product reviews, and correspondence with FG's customer care.
Payment information: FG does not store Your card, net-banking or wallet credentials. Payments are processed directly by FG's PCI-DSS compliant payment gateway partners, and only limited transaction metadata (such as payment status and amount) is shared with FG.
Information collected automatically: Internet Protocol address, device and browser identifiers, approximate geographic location, pages viewed, time spent on the Platform, referring and exit pages, and other log data, collected through cookies and similar technologies as described in Clause 5 below.
Information from other sources: updated delivery or address information from FG's logistics and courier partners, and information You choose to share by connecting a social media account to the Platform (such as Your name, profile picture or e-mail address associated with that account).
FG does not seek to collect Sensitive Personal Data or Information such as health data, biometric data or information relating to sexual orientation. Where any category of information falling within Rule 3 of the SPDI Rules is collected (for example, financial information in the limited circumstances described in Clause 2.2), the same is collected, stored and processed strictly in accordance with the SPDI Rules and only with Your consent.

HOW INFORMATION IS COLLECTED
FG collects information when You: register an account on the Platform; place an order or make a purchase; browse or use service or feature on the Platform; participate in a contest survey or loyalty programme; correspond with FG’s customer service by phone, e-mail, chat or otherwise; post a review or comment; connect a social media account to the Platform; or otherwise interact with FG, including at FG’s retail stores or exhibitions where You choose to share Your contact details.

PURPOSE OF COLLECTION AND PROCESSING OF INFORMATION
FG collects, uses, stores and processes Your information for the following purposes ("Purposes"):
- to create and administer Your account and facilitate Your use of the Platform;
- to process and fulfil Your orders, including payment processing, delivery, exchanges and returns;
- to respond to Your enquiries and provide customer support;
- to send transactional and administrative communications regarding the Platform and Your orders;
- to send You marketing and promotional communications, where You have not opted out of the same;
- to personalise Your experience on the Platform and recommend products that may interest You;
- to conduct internal reviews, data analysis and research to improve the Platform and FG's products and services;
- to detect, prevent and investigate fraud, security incidents and other illegal activity;
- to comply with Applicable Law, and to respond to requests from courts, tribunals, arbitral bodies, law enforcement and regulatory or statutory authorities;
- to establish, exercise or defend FG's legal rights; and
- to enable a potential buyer, investor or successor entity to evaluate FG's business, in connection with a proposed merger, acquisition, restructuring or sale of assets.

SHARING AND DISCLOSURE OF INFORMATION
FG does not sell Your Personal Information to any third party.
FG may share Your information, strictly for the Purposes set out in Clause 4, with: (a) FG's group companies and affiliates; (b) third-party service providers, including payment gateways, logistics and courier partners, information technology and hosting providers, and marketing and analytics providers, each of whom is bound by contractual confidentiality and data protection obligations; and (c) FG's professional advisors, including auditors and legal counsel, where necessary.
FG may disclose Your information where required to do so by Applicable Law, or in response to a valid request from a court, tribunal, arbitral body, law enforcement agency, or any statutory, regulatory or governmental authority.
In the event of a merger, acquisition, restructuring or sale of all or part of FG's business or assets, Your information may be transferred to the successor entity, which will continue to be bound by the terms of this Privacy Policy in respect of information transferred to it.
No disclosure or sharing of Your information under this Clause 5 shall result in wrongful loss to You or wrongful gain to FG or any third party.

COOKIES AND SIMILAR TECHNOLOGIES
The Platform uses cookies and similar tracking technologies, including strictly necessary cookies (required for the Platform to function and for security), functional cookies (to remember Your preferences), and performance or analytics cookies (to understand how the Platform is used.
You may configure Your browser to alert You before accepting cookies, or to refuse cookies altogether. Disabling cookies may affect the availability of certain features of the Platform.
The Platform does not currently respond to "Do Not Track" browser signals.

DATA STORAGE, RETENTION AND DELETION
Your information is retained for as long as necessary to fulfil the Purposes for which it was collected, and thereafter for such further period as may be required to comply with FG's obligations under Applicable Law, including tax, accounting, audit and consumer protection requirements.
You may request deletion of Your Personal Information and closure of Your account by writing to FG at the e-mail address set out in Clause 14. FG will act on such a request within a reasonable time, subject to FG's right to retain information where required by Applicable Law or for the establishment, exercise or defence of legal claims.
Residual copies of Your information may continue to exist in FG's backup systems for a limited period after deletion, for the purpose of guarding against accidental loss or destruction of data.

DATA SECURITY
FG has implemented reasonable security practices and procedures, comprising administrative, technical and physical safeguards, in accordance with Section 43A of the Information Technology Act, 2000 and the SPDI Rules, to protect Your information against unauthorised access, alteration, disclosure or destruction.
Third parties engaged by FG to process Your information are required, under contract, to adopt security standards consistent with FG's own practices.
No method of transmission over the internet or electronic storage is entirely secure, and FG cannot guarantee the absolute security of Your information.

CROSS-BORDER TRANSFER INFORMATION
Your information is primarily stored on servers located in India. FG may engage service providers located outside India (including cloud hosting, analytics or customer support providers) who may process Your information outside India, subject to contractual data protection obligations consistent with this Privacy Policy and Applicable Law, including any restrictions on transfer to specific jurisdictions that may be notified by the Central Government under Section 16 of the DPDP Act.

CHILDREN’S PRIVACY
FG does not knowingly collect Personal Information from a person below eighteen (18) years of age without the verifiable consent of that person's parent or lawful guardian.
